Case No. 407 of 2024, corresponding to Special POCSO Case No.80 of 2024, for the offence under Section 96 of B.N.S. and Sections 8 & 12 of POCSO Act, subsequently, charge framed under Sections 137, 87 & 351 of B.N.S and Sections 8 & 12 of POCSO Act, pending in the court of Sri Vishal Kumar, learned Additional Session Judge-III-cum-Special Judge, POCSO Act, Hazaribag. Bail application of the petitioner was earlier rejected by this Court vide B.A. No.1747/2025, by order dated 04.03.2025. On 29.09.2024, petitioner is alleged to have enticed away 17 years old daughter of the informant to leave her lawful guardianship with an intention to marry her. Attention has been drawn towards the statement of the victim recorded under Section 183 of the B.N.S.S., in which, she has stated that the petitioner had not entered into physical relationship with her. In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Vishal Kumar, learned Additional Session Judge-III-cum-Special Judge, POCSO Act, Hazaribag, in connection with Barhi P.S.
