1. Petitioner has filed this petition with the following reliefs:

Wps 9876 of 2025 2 10.2 That, this Hon’ble Court may kindly be pleased order any appropriate Writ/Writ(s), Direction/Directions(s) to set aside the order dated 14.08.2025 (Annexure P1) passed by the Respondent No.1 being arbitrary, illegal and non-est in the eyes of law. 10.3 The Hon’ble Court may kindly be pleased to grant any other Relief/Relief(s), Direction/Directions(s) in favour of the petitioner as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case. 10.4 Award cost of proceedings in favour of the Petitioner.”

Learned counsel for the petitioner would submit that vide order dated 14.08.2025, petitioner has been suspended on the ground that on quality examination of rice, the broken particles of rice was found to be 29.6%, and slightly damaged grains were found 3.70% which is beyond the limit fixed by the Government, and thereby, the petitioner approved the lot of said rice, while it was accepted by the department, and the act of the petitioner his misconduct under Rule-3 of the Civil Service Conduct Rules, 1965 and he was suspended. He would submit that as per the standard of rice to be issued to the State Government/undertaking administration for distribution under TPDS, and other welfare schemes, the maximum percentage of slightly damaged grains are 5%, broken rice is of 30%, whereas, the discrepancy mentioned in the said order dated 14.08.2025 is within the limit, as shown in the said schedule described the maximum permissible limit. He would further submit that raising his grievance, petitioner may be permitted to make a representation to the respondent authorities, who shall take a decision within the stipulated time frame, in accordance with said maximum permissible limit of the grains, and also in accordance with applicable rules, and Circulars, holding the field.

3. On the other hand, learned counsel for the respondents has no objection if such a direction is being given to the authorities concerned to take a decision on the representation of the petitioner in accordance with applicable rules, and Circulars, holding the field.

Considering the submissions made by learned counsel for the petitioner, present petition stands disposed of directing the petitioner to make a detailed representation along with copy of this Order, and submit to the respondent authority/competent authority within a week from today and in the eventuality of filing such representation, the respondent authorities/competent authority shall take a decision on the representation of the petitioner within a period of further two weeks from the date of its receipt, in accordance with applicable rules, and Circulars, keeping in mind the maximum permissible limit of the grains, applicable to the respondent authorities/Corporation, after providing opportunity of hearing to the petitioner.
