Heard learned counsel for the petitioner and Sri Kailash Nath Singh, learned Counsel for the respondent. This writ petition has been filed with the following prayer:- "a) Issue a direction, directing the learned trail court to decide the original suit no 787 of 2021 (Vansraj vs Ramdavar) pending in the court of Addiional Civil Judge (J.D) New Court VII Jaunpur in pursuance of compromise dated 2.3.2022 expeditiously within stipulated time as fix by this Hon'ble court." It is contended by learned counsel for the petitioner that a compromise application has been moved on 02.03.2022 which is pending consideration since then. The prayer made in the writ petition cannot be granted in view of recent judgment of Constitution Bench of Hon'ble Supreme Court rendered in case of High Court Bar Association, Allahabad vs. State of Uttar Pradesh and others (2024) 6 SCC 267. However, as the compromise application is pending consideration since 2022, no useful purpose would be served in keeping the matter pending or calling for counter affidavit or issuing notice to the sole respondent, at this stage. The Court below is hereby directed to proceed with the compromise application filed on 02.03.2022 and pass necessary order, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
