NATARAJ ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct the respondent No.3 to consider his representations dated 13.02.2015 and 07.05.2025 regarding division of the khatha of the property bearing old No.103/1, new No.11 situated at Hoskerehalli Main Road, Mysore Road, Byatarayanapura ward No.41. - 3 - HC-KAR NC: 2025:KHC:49106 WP No. 33213 of 2025 2. The petitioner claims that he is in lawful possession and enjoyment of the aforesaid property which he purchased in terms of a sale deed dated 07.07.1990 from its previous owner. He claims that after such purchase, he submitted representations to the respondent No.3 requesting to divide the khatha of the said property and issue separate khatha in his name. However, no action was taken by the respondents and therefore, the petitioner submitted a representation dated 13.02.2015. The petitioner was then called upon to produce documents in support of his claim vide endorsement dated 02.05.2025. The petitioner submitted all the documents as sought for. However, the same is not considered till date. The petitioner is therefore before this Court seeking for a direction to consider the representation and pass appropriate orders for bifurcation of the khatha and record the independent khatha of the property purchased by the petitioner. 3. The learned counsel for the petitioner reiterated the above submissions and prayed that a direction be issued to the respondent No.3, who is bound in law to consider the representations. - 4 - HC-KAR NC: 2025:KHC:49106 WP No. 33213 of 2025 4. The learned counsel for the respondent Nos.1 to 3 submits that if reasonable time is granted, the respondent No.3 would consider the same in accordance with law. 5. In view of the above, the writ petition is disposed off, directing the respondent Nos.1 to 3 to consider the representations dated 13.02.2015 and 07.05.2025 and issue an appropriate reply to the petitioner in accordance with law within a period of three months from the date of receipt of a copy of this order.
