Order No.
ORDER(ORAL) 21.04.2026
05. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is the bail application U/S.483 of the BNSS by the petitioners for grant of bail in connection with Ganjam PS Case No. 270 of 2025 corresponding to GR Case No.1306 of 2025 pending in the Court of learned SDJM, Chatrapur for commission of offences punishable U/Ss.319(2)/ 318(4)/ 337/ 338/ 340(2)/61(2)/3(5) of BNS, on the main allegation of cheating the informant by managing to execute the sale deed for selling a piece of land by impersonating the co-accused in place of the dead recorded tenant of the land as seller, by way of forging documents. 3. Heard, Mr. Anupam Dash, learned counsel for the petitioners and Mr. R.B. Mishra, learned Additional Public Prosecutor in the matter and perused the record. On being queried about the criminal antecedent of the petitioners, Mr. Dash volunteers to withhold bail to the p. 2 petitioners, if he/they is/are found to have any criminal antecedent of similar nature. 4. Admittedly, after having availed opportunities, the learned Addl. PP has not yet produced the instruction relating to this case, but the allegation appearing against the Petitioners is for parting of Rs. 13,50,000/- allegedly obtained by executing fictitious sale deed, however, the Petitioners are in custody since 24.08.2025, but in the meantime, charge sheet has already been submitted. All the offences are stated to be triable by Magistrate. In the aforesaid facts and circumstance and taking into consideration the pre trial detention of the Petitioners in custody and there being inherent right of the accused to be presumed innocent until proven guilty at the trial and no criminal antecedent being reported against any of the Petitioners and there being no material collected to indicate that the Petitioners would abscond, if released on bail, this Court without expressing any view on merit admits the petitioners to bail, but subject to verification of their criminal antecedent. 5. Hence, the bail application of the petitioners stands allowed and they are allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. p. 3 In view of the specific submission as advanced for the petitioners, the benefit of this order shall not be extended to the concerned petitioner(s), if he/they is/are found to have any criminal antecedent of similar nature. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e- mail for reference. (G. Satapathy)
