THE SUBINSPECTOR OF POLICE, VARIKUNTAPADU POLICE STATION, SPSR NELLORE DISTRICT. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ more particularly one in the nature of Writ of Mandamus declaring the action of respondent 3 and 4 herein in pressurising the petitioners and the other villagers of Kondareddipalle G Village, Varikuntapadu Mandal SPSR Nellore District to include persons of other villages who do not hail from Kondareddypalle G Village, in Ramula Vari Tirunalu celebrations without any manner of right much less any legal right as illegal, arbitrary and opposed to the established principles of law 2 and further in violation of customary rights of the village and consequently direct the respondents herein to not to interfere with the customs of the village and pass IA NO: 1 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents herein more particularly the 3rd and 4th respondents herein to not to harass the petitioners and other villagers of Kondareddipalle G Village, Varikuntapadu Mandal SPSR Nellore District to include persons of other villages who do not hail from Kondareddypalle G Village, in Ramula Vari Tirunalu celebrations by directing not to interfere with the customary rights of the village pending disposal of the present writ petition and pass IA NO: 2 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to implead the petitioners herein as respondents no.5 to 23 in WP. 12659/2022 as well as all IAs Counsel for the Petitioner(S): 1. GP FOR HOME 3 The Court made the following: ORDER: The instant Writ Petition is filed by the Petitioners seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief: “.... to issue an appropriate Writ more particularly one in the nature of Writ of Mandamus declaring the action of respondents 3 and 4 herein in pressurising the petitioners and the other villagers of Kondareddipalle G Village, Varikuntapadu Mandal SPSR Nellore District to include persons of other villages who do not hail from Kondareddypalle G Village, in Ramula Vari Tirunalu celebrations without any manner of right much less any legal right as illegal, arbitrary and opposed to the established principles of law and further in violation of customary rights of the village and consequently direct the respondents herein to not to interfere with the customs of the village and pass ...” At the time of hearing, learned Assistant Government Pleader for Home appearing for respondent State placed on record the written instructions and would submit that petitioners and unofficial respondents hail from Kodareddypalli village and the quarrel is with regard to performing rituals of Sri Ramula Vari Temple. As per the complaint given by complainant on 24.4.2022, the subject crime is registered. Except registration of crime, respondent Police never interfered in the matters of the parties and all the allegations are false and baseless and would submit that appropriate orders may be passed by disposing of this Writ Petition. Learned counsel for petitioners would submit that recording the said submission, the writ petition may be disposed of. 4 In the light of the submissions made, this Writ Petition is disposed of. Petitioners are liberty to recourse the remedy before appropriate forum according to law, as and when required, if so advised. No order as to costs. Pending applications, if any, shall stand closed.
