Acharya, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 29.07.2025 02. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is an application U/S.483 of BNSS by the petitioners for grant of bail in connection with Baranga PS Case No.437 of 2024 arising out of GR Case No.1264 of 2024, pending in the Court of learned JMFC (II), Cuttack for commission of offences punishable U/S. 310(2) of BNS r/w Sec.25(1)(a)/27(1) of Arms Act, on the allegation of snatching away one gold chain from the informant by assaulting him near Omfed Plant, Naraj. 3. Heard, Mr. Bideshi Kumar Ghadei, learned counsel for the petitioners and Mr. T.K. Acharya, learned Additional Public Prosecutor in the matter and perused the record. 4. Admittedly, the co-accused persons namely Salu @ Dilip Parida and Sachikanta Behera in BLAPL Nos.896 & 1446 of 2025 have already been granted bail by a co-ordinate Bench of this Court, but the petitioners are in custody since 21.12.2024 with submission of charge-sheet in the meantime. The FIR has been lodged against unknown persons. In such view of the matter and after having considered the rival submissions and taking into account the mode and manner of implication of the present petitioners in this case and regard being had to the pre-trial detention of the petitioners in custody, this Court without expressing any view on merit admits the petitioners to bail. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:- (i) the petitioner shall report attendance before the Jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10 A.M. to 12 Noon for six (06) months from the actual date of release from the custody. The I.I.C. of Jurisdictional Police Station shall not detain the petitioner unnecessarily after recording his attendance beyond the time as stipulated. 6.
