State Of Rajasthan, Through Public Prosecutor. ----Respondent 2. Shri Vikas Soni S/o Shri Jairam Soni, Director V2V Cyber Security Pvt. Ltd. Address 3Rd Floor Birla Sons Building, Dcm, Vaishali Nagar, Jaipur, Rajasthan. ----Complainant/Respondent For Petitioner(s) : Mr. Vedant Sharma with Mr. Shivam Sharma For Respondent(s) : Mr. Naresh Gupta, PP HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Order 10/10/2025 This criminal miscellaneous petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed for quashing the FIR No.324/2024 dated 09.07.2024 registered at Police Station Chitrakoot, District Jaipur (West) for the offence under Sections 420, 499 and 120-B of IPC and Sections 43, 66, 65 and 66(C) of IT Act, 2008. Learned counsel for the petitioner contends that the allegations are of civil nature. He further submits that the dispute with regard to his illegal termination from service is pending consideration before an arbitrator appointed by this Court. He, [2025:RJ-JP:41346] (2 of 3) [CRLMP-6100/2025] therefore, prays that the criminal miscellaneous petition be allowed and the subject FIR be quashed and set aside. Learned Public Prosecutor opposed the prayer. Heard. Considered. A perusal of the contents of subject FIR reveals disclosure of commission of cognizable offence. It is specifically alleged in the FIR that:- “3. ;g fd ifjoknh dh dEiuh }kjk vfHk;qäx.k dks c[kkZLr fd;s tkus ij vfHk;qäx.k }kjk ifjoknh dh dEiuh dks vuqfpr gkfu igaqpkus ,oa Lo;a vuqfpr :i ls ykHk izkIr djus o vU; fdlh dEiuh ds lkFk feydj dEiuh dh Nfo o dk;Z'kSyh [kjkc djus ds dqfRlr mns'; ls dEiuh ds vkbZ ih ,Mªsl ds lkslZ dksM dks pqjkdj mls DykmM Lisl ls fMyhV dj fn;k] ftlds dkj.k fuEufyf[kr osclkbZV o vkWuykbZu Mksesu loZj dk;Z ugh dj jgs gSA loginradius.com, ircontent.com, ircontent2.com, div4.info, div4.dev, internal.com, loginradius.work, loginradius.work, loginradius.net, loginradius.co, loginradius.io, loginradius.in, loginradius.us, loginradius.ca, janra.in” It is further alleged in the FIR as under:- “5. ;g fd vfHk;qäx.k] dEiuh ds xzkgdks dks Lisl esy bR;kfn Hkstdj dEiuh dh Nfo [kjkc dj mls xaHkhj uqdlku dkfjr djus dk iz;kl dj jgs gSA” In view of the aforesaid categorical allegations in the FIR, contention of the learned counsel for the petitioner that the dispute, purely of civil nature has been given criminal colour, cannot be countenanced. [2025:RJ-JP:41346] (3 of 3) [CRLMP-6100/2025] His another limb of submission does not merit acceptance. Mere pendency of the dispute as to termination of his service before an arbitrator is no ground to quash the FIR which contains allegations disclosing commission of cognizable offence. Resultantly, this criminal miscellaneous petition is dismissed being devoid of merit. Pending application(s), if any, also stands disposed of accordingly. (MAHENDAR KUMAR GOYAL),J PRAGATI/47
