1. The petitioner has filed this writ petition on the following relief:
“10.1. That the Hon’ble Court may kindly be pleased to call for the entire record pertaining to the instant case. 10.2 That the Hon’ble Court may kindly be pleased to issue a writ in nature of mandamus whereby to direct to respondent authorities to shift the proposed construction of NH 343 approximately 2 kilometers before the town where mostly government land are available. 10.3 That, the Hon’ble Court may kindly be pleased to direct the respondent authority to modify the proposed construction of the national highway NH-343 which is passing in middle of town Ramanujganj whereby this raises serious safety concerns, as it may lead to accidents. 10.4 That, any other relief may also be granted to the petitioner which this Hon’ble Court deems fit and proper in the facts and circumstances of the case.”
2. Learned counsel for the petitioner submits that by way of this petition, the petitioners challenging the action on the part of respondent authorities who are not doing the new changing
3 route/path of the National Highway No. NH- 343 which is for protection to Ramanujganj town in respect of construction of the National Highway No. NH-343. The Government of India, Ministry of Road Transport and Highway issued a notification dated 29.05.2020 in Gazette of Government of India whereby they acquired the land of Ramanujganj town as well as of other places and called for an objection from the citizens of the Ramanujganj town whose land has been acquired for construction of National Highway No. NH- 343. He further contends that the petitioner has submitted his representation before Collector, Ramanujganj.
3. Learned State Counsel opposed the submission made by the counsel for the petitioner.
4. Heard learned counsel for the respective parties and perused the record with utmost circumspection.
5. Looking to the entire facts and circumstances of the case,
submissions of the counsels, since the petitioner has already submitted his representation before the Collector, Ramanujganj, therefore, the petitioner is advised to pursue the matter before the Collector,, Ramanujganj, if so desire.
6. In view of the above, the present petition is disposed of. Sd/-
