ORDER ON BOARD 11/09/2025
1. This is the first bail application filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 124/2025 registered at Police Station – Hathband, District – Balodabazar-Bhatapara, Chhattisgarh for the offences punishable under Sections 137 (2), 87, 64, 64 (2) (n), 65 (1) r/w. Section 3 (5) of Bharatiya Nyaya Sanhita, 2023 and under Sections 04 & 06 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.
2. Case of prosecution is that, applicant took the minor sisters on his motorcycle from their village to Raipur. One of whom was aged about 12 years and another 15 years. The applicant left one victim aged 12 years SHUBHAM DEY Digitally signed by SHUBHAM DEY
2 at Raipur in the company of Sanjay Gendre (his nephew) and took another victim aged 15 years to Kanpur on train and left her in the company of one Rohit. During course of investigation, victims were recovered, based on their statement the applicant was arrested.

Learned counsel for the applicant submit that applicant is innocent, he has been falsely implicated in the instant crime, he has not committed any offence as alleged. He submits that there is no allegation against the applicant of sexual assault, but as per allegations, he took the two sisters (victims) on his motorcycle to Raipur. Applicant is in jail since 22.06.2025, hence, he may be enlarged on bail.

On the other hand, learned State counsel vehemently opposes the submission made by learned counsel for the applicant and would submit that specific allegations have been leveled against the applicant that he took the two minor sisters on his motorcycle from their village to Raipur and thereafter, took one of victim to Kanpur and handed over to other persons. In support of his contention, he read over the statement of the victims recorded under Section 183 of the BNSS, 2023.
5. I have heard learned counsel for the respective parties.

Taking into consideration, facts and circumstances of the case, nature of allegations, submission of learned counsel for the respective parties, age of the victims to be 12 & 15 years, documents enclosed along with the bail application, I do not find present to be a fit case to allow the application for grant of bail.
