Heard the parties.
Petitioner has been made accused in connection with Netarhat P.S. Case No.01 of 2023, corresponding to G.R. Case No.214 of 2023 and S.T. Case No.154 of 2023 for the offences registered under Sections 302, 325, 506/ 34 of the I.P.C. and charge has been framed under Sections 302/34, 325/34, 506/34 of the I.P.C., pending in the Court of learned Sessions Judge, Latehar.
Bail Application of the petitioner was earlier rejected by this Court vide B.A.7889 of 2024 by order dated 12.02.2025. On 22.01.2023 at about 1:00 noon, the petitioner along with co- accused Binod Brijiya are alleged to have assaulted the husband of the informant by lathi, due to which, he succumbed to his injuries. Report regarding the stage of trial, earlier called for, has been received. It appears that out of 8 charge-sheeted witnesses, 5 witnesses have already been examined. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. Learned trial court is directed to expedite the trial and preferably conclude the same within four months from the next date fixed for recording of evidence, failing which the petitioner, if so advised, may renew his prayer for bail.
