Order 16/09/2025
1. The present writ petition has been filed by the petitioner with the following prayer:-
“In light of the foregoing facts and circumstances, the Writ Petitioner respectfully prays that this Hon’ble court be pleased to:
[2025:RJ-JP:37636] (2 of 3) [CW-11983/2025] a) Issue an appropriate writ, order, or direction quashing the arbitrary, illegal, and mala fide debit freeze imposed on the bank account of the writ petitioner; b) Direct Respondent No. 2 & 3 to furnish the writ petitioner with a copy of the FIR and any relevant materials relied upon to justify the excessive measure of freezing the entire account; c) Direct Respondent No. 2 & 3 to compensate the Petitioner for the financial loss, market credibility loss and reputational damage caused due to the arbitrary freeze imposed by Respondents without following due process by paying an amount of INR. 1,00,000/-. d) Pass such other and further reliefs as this Hon'ble Court may deem fit and proper in the interest of justice.”
2. At the outset, an objection has been taken by the counsel appearing on behalf of the respondents that no cause of action has arisen with the petitioner to approach this Court by way of filing the present writ petition. Learned counsel submits that the petitioner is a resident of State of Tamil Nadu and his bank account is also pertaining to Axis Bank situated at No.131, Sooriyanarayana Road, Royapuram Chennai, Tamil Nadu, hence, under these circumstances, this Court has no territorial jurisdiction to entertain this writ petition. 3. Per contra, learned counsel for the petitioner opposes the aforesaid submissions made by learned counsel for the respondents and submits that since it is true that the petitioner is a resident of the State of Tamil Nadu and his bank account is also lying with the Axis Bank at Tamil Nadu, but the same has been freezed at the instance of a letter received from the Police Station at Dholpur within the State of Rajasthan, hence, under these circumstances, the petitioner has invoked the jurisdiction of this Court contained under Article 226 of the Constitution of India. [2025:RJ-JP:37636] (3 of 3) [CW-11983/2025]
4. In the considered opinion of this Court, no cause of action has arisen with the petitioner to approach this Court as nothing has happened within the territorial jurisdiction of this Court.
The cause of action has arisen with the petitioner at Tamil Nadu, hence, under these circumstances, the petitioner is expected to approach the Court concerned for redressal of his grievances. 5. Accordingly, the writ petition stands disposed of. Stay application as well as all applications (pending, if any) also stand
disposed of.
