Mr. Suresh Budaniya, ADv. Mr. Vikash Bajiya, Adv. Mr. Shafiqur Rahman, Adv. Mr. Akshay Sharma, Adv. For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 17/01/2025 1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.66/2024, registered at Police Station Special Police Station (SOG), District ATS & SOG for the offence(s) under Sections 420, 467, 468, 471, 201 and 120-B of IPC and Sections 3, 4, 6 and 10 of The Rajasthan Public Examination (Measures to Prevent Unfair Means in Recruitment) Act, 2022. 2. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. It is argued that the case of the petitioners are akin to the case of the other co-accused Kamalkant, Ramlal and Lilipal, who were enlarged on bail by this Court vide order dated 20.12.2024. It is alleged against the accused-petitioners that they provided their sim to the main accused Paurav Kaler. The accused-petitioner are in custody since 26.12.2024, the charge-sheet has already been produced before the concerned Court, the charge-sheet filed is voluminous with atleast 90 witnesses cited by the prosecution, therefore, considering the period of incarceration and probable time in [2025:RJ-JP:2445] (3 of 5) [CRLMB-461/2025] conclusion of the trial, the bail application of the accused- petitioners may be allowed. 3. Further, counsel for the accused petitioner-Surajram contended that the accused petitioner-Surajram has falsely been implicated under Sections 420, 467, 468, 471 and 120-B of IPC and Sections 3, 4, 6 and 10 of The Rajasthan Public Examination (Measures to Prevent Unfair Means in Recruitment) Act, 2022. It is alleged against the accused-petitioner-Surajram that he was in contact with the main accused Paurav Kaler on 13.05.2023. It is also argued that the examination for the post of Revenue Officer Grade -II was conducted on 14.05.2023, and apart from those two calls made to the main accused Paurav Kaler on 12.05.2023, there is no incriminating substance recovered from the possession of the accused-petitioner, the accused-petitioner is a Government servant and behind the bars since 06.12.2024, against him also Police has submitted the charge-sheet along with the other co- accused, and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner-Surajram may also be allowed. 4. Learned Public Prosecutor has vehemently opposed the grant of bail applications. 5. Heard and perused the material available on the record. 6. As far as the accused-petitioners Vikesh Kumar Maan & Ramprakash are concerned, it is alleged against them that they provided their sim to the main accused Paurav Kaler. It is not alleged against the accused-petitioners that they were involved in providing information to the candidates who appeared in the examination of Revenue Officer Grade- II, conducted by the [2025:RJ-JP:2445] (4 of 5) [CRLMB-461/2025] R.P.S.C., the charge-sheet has already been produced against the accused-petitioners and the charge-sheet itself is voluminous having 90 witnesses. 7. With regard to the other accused-petitioner Surajram, it is alleged that he was also in contact with the other main accused Paurav Kaler on 13.05.2023, responsible for paper leaking and providing information to the candidates who appeared in the examination. It is contend that apart from the two calls made on 13.05.2023 to the main accused Paurav Kaler, there is no other incriminating material available against the accused-petitioners implicating his involvement in facilitating the candidates answers of the question paper for the examination of the Revenue Grade-II Officer, therefore, considering the above facts the charge-sheet has already been produced and the chargesheet itself is voluminous containing list of 90 witnesses cited by the prosecution, the accused petitioner-Surajram is behind the bars since 06.12.2024 and trial of the case may take considerable time, therefore, I deem it just and proper to enlarge the accused- petitioners on bail. 8. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused-petitioners namely; 1. Vikesh Kumar Maan S/o Sh. Sohan Lal, 2. Ramprakash S/o Shri Radhakishan and 3. Surjaram son of Shri Ramlal, in connection FIR No.66/2024, registered at Police Station Special Police Station (SOG), District ATS & SOG, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance [2025:RJ-JP:2445] (5 of 5) [CRLMB-461/2025] before the court concerned on all the dates of hearing and as and when called upon to do so. 9.
