For Petitioner(s): Mr.R.Rajarajan For Respondent: Mr.U.Baranidharan Special Government Pleader for R1 and R2 ORDER This writ petition has been filed for the issue of writ of Mandamus directing the 2 nd respondent to register the agreement of sale dated 26.02.2025 executed by the petitioner and his sister in favour of the 4 th respondent. 2. Heard Mr.R.Rajarajan, learned counsel for the petitioner and Mr.U.Baranidharan, learned Special Government Pleader for respondents 1 and 2. https://www.mhc.tn.gov.in/judis WP No. 11925 of 2025 3. The agreement of sale dated 26.02.2025 was refused to be registered by the 2 nd repsondent on the ground that there is a dispute between the petitioner and the power of attorney agent, who was initially permitted to deal with the property and thereafter, his power of attorney document was cancelled. Since the cancellation deed is pending, the 2 nd respondent did not register the agreement of sale presented by the petitioner. 4. In the considered view of this Court, a dispute between the petitioner and the power of attorney agent need not be gone into by the 2 nd respondent and it is for them to resolve the same before the competent Civil Court. The petitioner and his sister, as the owner of the property, are entitled to deal with the property and hence, the document presented by them for registration has to be entertained, if it is otherwise in order. 5. This writ petition is disposed of in the above terms.
