GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the part of the 2nd respondent in not consider the petitioner's representation dated 30- 2 03-2022, is as arbitrary, illegal, abdication of the statutory duty cast on him and violate the fundamental rights guaranteed to the petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently direct the 2nd to 6th respondents for conducting investigation in Cr. No.98/ 2017, dated 05-09-2017 on the file of the Kaligiri Police Station, and file charge sheet as procedure contemplated 173(2) of Criminal Procedure Code 1973.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, Police conducted investigation in Crime No.98 of 2017 on the file of the Kaligiri Police Station, which was registered for the offence under Section 304-A IPC and could not trace out the Accused. Hence, the Police referred the said crime ‘Un Detectable’ vide C.No.22/Ref- SDO.K/2019, dated 01.03.2019. Therefore, no further orders are required in this matter and the petition may be disposed of. 3. Sri P.V.S.K.Chakravarthy, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out his remedy before appropriate Court in accordance with law. There shall be no order as to costs.
