JUSTICE RAJESH SHANKAR ----- For the Petitioners: Mr. Rahul Ranjan For the State: Ms. Nehala Sharmin, A.P.P ----- 02/31.01.2025 The present Cr.M.P has been filed for restoration of A.B.A. No. 2790/2024, which could not be restored due to non-compliance of the order dated 13.12.2024 passed in Cr.M.P No. 3349/2024. 2. Learned counsel for the petitioners submits that A.B.A. No. 2790/2024 earlier stood dismissed for non-compliance of the peremptory order dated 25.07.2024. Thereafter, Cr.M.P No. 3349/2024 was filed on behalf of the petitioners seeking restoration of the said A.B.A. This Court vide order dated 13.12.2024 restored the same to its original file and stage with the condition of removing the remaining defect pointed out by the office by 20.12.2024. The said remaining defect was regarding filing of the certified copy of the impugned order. However, inadvertently instead of the same, the certified copy of the FIR was filed, as a result of which, A.B.A. No. 2790/2024 could not be restored to its original file and stage in view of the condition imposed vide the order dated 13.12.2024. 3. Learned counsel for the petitioners further submits that he has already obtained the certified copy of the impugned order and he will file the same positively within a week. Hence, A.B.A. No. 2790/2024 may be ordered to be restored to its original file and stage by way of last indulgence. 4. Having heard learned counsel for the parties and for the reasons stated in the present Cr.M.P, A.B.A. No. 2790/2024 is restored to its original file and stage, subject to the conditions that the petitioners shall pay a cost of Rs.1,000/- in favour of the Advocate’s Clerks Association Welfare Fund, Jharkhand High Court, Ranchi and further that they shall remove the remaining defect(s) pointed out by the office in the said anticipatory bail application by 07.02.2025. 5.
