DR,J WP.No.29719 of 2025 The Court made the following ORDER: This writ petition, under article 226 of the Constitution of India, is filed seeking the following prayer:
“…to issue an Order or a Direction or a Writ more in the nature of writ of mandamus by declaring the action of 4th Respondent herein in dispossessing the Petitioner herein from the assigned land under D Form patta issued on 15.10.1976 admeasuring Ac.0.05 cents covered under Sy.No.832/6 situated at Chintalapudi Village and Mandal, Eluru District without issuing prior notice or conducting enquiry as arbitrary, autocratic, illegal, ultra vires and against the principles of natural justice consequently direct the Respondents not to dispossess the Petitioner herein from the above mentioned land without due process of law… “
2. Considering the submissions, this Court passed the following interim
order on 30.10.2025.
“
Learned counsel for petitioner is permitted to takeout personal notice to respondent Nos.6 and 7 through registered post with acknowledgment due and file proof of service in the Registry.
The grievance of the petitioner is that respondent authorities have granted D-form patta on 14.10.1976. Since then, petitioner’s family has been in peaceful possession and enjoyment over the subject property. Now, the respondents are interfering with the petitioner’s property. Hence, the present writ petition is filed seeking a direction to respondents not to dispossess the petitioner from the land in an extent of Ac.0.05 cents in Sy.No.832/6 situated at Chintalapudi Village and Mandal, Eluru District, without following due process of law. …...
Meanwhile, respondents are directed to maintain Status Quo
existing as on today”
3. In compliance to the orders, the petitioner has taken out notices to respondent Nos.6 and 7 and filed proof of service.

4. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents.
5. Learned Assistant Government Pleader based on the written instructions furnished by the Tahsildar/ 4th respondent submits that the respondent authorities never interfered into the possession of the petitioner and they are not intending to dispossess the petitioner.
6. Accordingly, the writ petition is disposed of and if at all, the petitioner has any grievance with unofficial respondents, the petitioner may approach appropriate forum according to law. As a sequel, all pending applications, if any, shall stand closed. ________________
