In this writ petition, the petitioner has prayed for grant of an appropriate writ in the nature of Mandamus or an order or direction commanding upon the respondents to consider the case of the petitioner for grant of benefit of 1st and 2nd Assured Career Progression Scheme and to pay all consequential benefits accrued thereunder including difference in retiral benefits within a specified period. 3. The petitioner was appointed in the post of Clerk in Abhiram High School, Pogra, Rangamati within Silli Block in the District of Ranchi. 4. He superannuated on 31st July, 2022 on completion of 58 years of age. 5. It is the case of the petitioner that his case was 2025:JHHC:33666 2 recommended for grant of the ACP benefits but the same has not been given. It is the case of the petitioner that the reasons for not granting the ACPs has also not been communicated to the petitioner. 6. Mr. A.K. Sahani, learned counsel appearing on behalf of the petitioner submits that suffice it would be if a direction is given to the respondents to consider the case of the petitioner and pass a reasoned order on the representation. 7. Learned counsel appearing on behalf of the State submits that if the petitioner files a fresh representation before Director, Secondary Education, Department, Government of Jharkhand, Ranchi, his case will be considered and if necessary, will be placed before a committee who takes decision on the grants of ACPs. 8. Considering the said submission, I direct the petitioner to file a detailed representation before the Director, Secondary Education, Department, Government of Jharkhand, Ranchi within a period of four weeks. On receipt of the said representation, the case of the petitioner will be considered by him within a period of eight weeks. If it is necessary to place the case of the petitioner before any committee, the same will be placed. If the petitioner is entitled for any relief, the same should be granted to the petitioner immediately within three weeks and the consequential monetary benefit should also be given to the petitioner and his pension should also be revised and the arrears should also be paid. If the claim of the petitioner is rejected for any reason, the reasoned order should be communicated to the petitioner. 9. The entire process should be concluded within a period of sixteen weeks from the date of receipt of copy of this order. 10. With the aforesaid observation and direction, this writ petition stands disposed of. 11. Before parting, I find that this writ petition was also filed in the year 2022 and the defect(s) were removed in 2023, yet the matter was not listed under the heading for “Fresh Filing (Admission)”. It is only when the matter is placed before this Court 2025:JHHC:33666 3 under the heading “Fresh Filling (Admission)”, the same has been taken note of by this Court. 12. Early two cases were also found with the same latches and most probably the person who was dealing the said files is same.
