2. The present writ petition has been filed by the petitioner with the following prayer:
“It is therefore, prayed that this Hon'ble Court may kindly be pleased to allow the petition and also be pleased to quash the charge sheet filed against him for the offence under Section 308, 201 of Indian Penal Code and Section 138 of Electricity Act-2003, arising out of the FIR No.558/2022 registered at Police Station City Kotwali, Raigarh, District Raigarh (C.G.) (Annexure P-1), in the interest of justcie.”

As per the report submitted by the concerned police station that respondent No.3, Nitesh Bhardwaj has died, hence, the notice could not be served to him and learned counsel for the petitioner as well as learned counsel for the State submit that the charges have been framed and trial is in progress and evidence is being recorded.
4. In view of the same and considering that the charges have been framed and evidence of the witnesses are being recorded, we are not inclined to interfere in the matter in such an advanced stage of trial and the present petition is dismissed on this ground alone, as there is no interim order passed in the present petition.
