No. KA 02 MK 4439) forthwith in the interest of justice and to pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the 4th / 5th respondent police to release unwarrentedly seized petitioner's company Vehicle (Maruti Suzuki Ciaz, Colour- Silver, Reg. This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“....to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of MANDAMUS declaring the action of the 4th / 5th respondent while interfering with the civil disputes of 6th respondent and his partner seizing 1st petitioner company's Vehicle (Maruti Suzuki Ciaz, Colour- Silver, Reg. No. KA 02 MK 4439) unauthorisedly at the instance of 6th respondent as illegal, arbitrary and unjust and consequently direct the 4th / 5th respondent authorities to release the 1st petitioners company said vehilce (Maruti Suzuki Ciaz, Colour- Silver, Reg. No. KA 02 MK 4439) forthwith in the interest of justice and to pass....”
2. None represented for the petitioner. 3. Sri V.Farooq, learned Assistant Government Pleader would submit that the police never seized the petitioner’s vehicle (Maruti Suzuki Ciaz, Colour- Silver, Reg. No. KA 02 MK 4439) nor interfere in the civil disputes between the petitioner and unofficial respondents. 5. Recording the same, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties, except under due process of law. There shall be no order as to costs.
