By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the measurement of his height in physical standard test held by the respondent recruitment board for the purpose of selection in U.P. Police Radio Head Operator/ Head Operator (Mechanic) Direct Recruitment, 2022. The grievance of the petitioner is that earlier in the selection held in the year 2015 by the same recruitment board, petitioner's height was measured as an accurate one and that is how he was permitted to participate in physical efficiency test. The admit card of the physical efficiency test has been brought on record as Annexure No. 7 to the writ petition. In the given facts and circumstances of the case, when the same recruitment board earlier found the height of the petitioner to be accurate one and for that reason he was permitted to appear in physical efficiency test, I direct the respondent board to consider the request of the petitioner to another round of height measurement and this time taking into consideration of fact that earlier the same board had found the height of the petitioner to be accurate one. The measurement of height shall be appropriately done but very carefully conducting height measurement. The appropriate orders in that regard shall be passed by respondent no. 2 soon after the presentation of certified copy of this order. It is made clear that this order has been passed in special facts and circumstances of this case in view of the fact that in earlier selection held by the same respondent, petitioner's height found to be accurate one and it shall not be a binding precedence.
