P SOMA SEKHARA NAIDU The Court made the following: 4 JS,J W.P.No.29082 of 2024 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in interfering with petitioners land to change the alignment of existing 400 kilovolts/high voltage transmission line of the 3rd respondent in such a manner that transmission towers/lines of the 3rd respondent will be installed in the land of the petitioner admeasuring an extent of 0.53 ½ cents in Survey No.191/1C1 of Jakkampudi village, Vijayawada Rural Mandal, N.T.R. District as arbitrary, illegal, without any authority and in violation of Article 14,21 and 300-A of the Constitution of India and consequently direct the respondents not to install any transmission tower or transmission line of the 3rd respondent in the lands of the petitioners and to pass such other order or orders as this Hon’ble Court may deem fit just and proper in the circumstances of the case.” 2. Learned counsel for the petitioner and learned counsel for the respondents fairly conceded that the issue involved in this writ petition is squarely covered by the order dated 28.10.2025 passed by a Division Bench of this Court in W.A.No.683 of 2024 and prayed that a similar 5 JS,J W.P.No.29082 of 2024 order may be passed in this writ petition. The operative portion of the said order reads as follows: “Mr.P.Veera Reddy, learned Senior Counsel appearing for National Highways Authority of India, upon instructions, submits that the authorities concerned have decided not to acquire the land of the appellant and would adopt other methods by raising the height of the existing towers on the existing alignment. In that view of the matter, learned counsel for the appellant does not wish to proceed any further in the matter. The proceedings are accordingly closed. In case any cause still survives, it will be open to the appellant to approach this Court again. Interim order shall stand vacated. No order as to costs.” 3. Accordingly, the Writ Petition is disposed of, in terms of the aforesaid order dated 28.10.2025 passed in W.A.No.683 of 2024. There shall be no order as to costs.
