A case has been registered against the petitioner herein and another for the offence punishable under section 20(b)(ii) read with 8(c), 20(b)(l') of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act'). 3. Case of the prosecution, in brief, is that, on 22.01.2020, at about 12.30 hours, on receipt of credible information, the Sub- Inspector of police, Nathavaram police station, along with his staff and mediators, while conducting vehicle checking at Chikkudupalem check-post, Nathavaram mandaI, found Al and A2 in possession and illegal transportation of 14 KGs of Ganja on a BaJ'aj Pulsar motor cycle bearing registration No.AP 31 EN 0862. A2 escaped from the spot. The police arrested Al and the contraband along with vehicle and other material was sel'zed under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to showthatAl is alleged to have made a confessional statement stating that the petitioner herein/A2 is the supplier of Ganja. Basing on the I €= Tt' t-=i---3=.-t| said confessional statement, the petitioner herein was shown as accused in the present crime. Except the confessional statement of co-accused, there is no other material to connect the petitioner herein to the alleged crime and no contraband is seized from his possession. Petitioner was arrested on execution of PT warrant on 26.ll.2024 and since then he is in judicial remand. The quantity of Ganja allegedly seized from the possession of Al is 14 Kgs, which is not a commercial quantity. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed. 6. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/A2 on the following conditions. i) The petitioner/A2 shall be released on bail on his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned Special Judge for trial of cases under the NDPS Act-Gum-I Additional Sessions Judge, Visakhapatnam. 7.
