The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.641/2022 registered at Police Station Sakri, District Bilaspur for offence under Sections 302, 120-B, 201, 341, 34 of the IPC and under Sections 25 & 27 of the Arms Act. 2. Case of the prosecution is that on 14th December, 2022, near village Sakri, Bilaspur, some unknown persons have committed murder of KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2025.09.25 17:23:50 +0530 2 deceased Sanju Tripathi by causing gunshot injuries to him. During investigation, it was revealed that the family members of the deceased had hired the contract killer to commit murder of the deceased. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. He was not present on the spot. The only allegation against the present applicant is that he was in touch with co-accused Prem Shriwas through his mobile and also supplied weapon i.e. pistol and 3 bullets to Prem Shriwas. Prior to the incident, the applicant has brought two other co-accused persons namely, Danish Ansari and Abhishek Mishra to Bilaspur to make the successful planning of murder of Sanju Tripathi. Even after the incident, he was in touch with other co-accused namely, Danish Ansari, a contract killer and Prem Shriwas. The applicant has been in jail since 8.8.2023 i.e. for more than 2 years. Some of the co-accused persons namely, Sumit Nirmalakar, Jay Narayan Tripathi, Aman Gupta, Rajendra Kumar Thakur & Kedar Singh have been released on bail by the Hon’ble Supreme Court and the case of the present applicant is similar to that of the co-accused persons. 4. On the other hand, learned State Counsel would oppose the bail application. However, he submits that the applicant does not have any criminal antecedents. 5. Considering the submissions of the parties, particularly considering the fact that the applicant was not present on the spot, looking to the length of pre-trial detention, conclusion of trial is likely to take some more time, the role attributed to the present applicant and other attending facts 3 and circumstances of the case, this Court is of the opinion that the applicant can be released on bail. 6. Accordingly, the Application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.1 lakh with 2 sureties for the like amount to the satisfaction of the trial Court.
