Neutral Citation No. - 2025:AHC:111287-DB Court No. - 29 Case :- WRIT - C No. - 46505 of 2009 Petitioner :- Jaspal Singh Respondent :- State of U.P. and Others Counsel for Petitioner :- Uma Nath Pandey Counsel for Respondent :- C.S.C.,R.K. Pandey,Ramendra P. Singh Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J. 1. Heard learned counsel for the petitioner, learned counsel for the contesting respondents, learned counsel appearing for respondent no.3, and perused the record. 2. The present writ petition has been filed in the year 2009, assailing the validity of the order dated 30.09.2008 passed by the Special Land Acquisition Officer, Greater Noida, District Gautam Budh Nagar. A further prayer has been made seeking a direction to restrain the concerned authorities from releasing the balance amount of compensation in favour of respondent no.4- private respondent. 3. When the matter was taken up today, learned counsel for the contesting respondents submitted that the dispute has already been adjudicated and resolved based on the claims considered by the competent authority. It is further submitted that at no point of time the petitioner's claim has been accepted by any competent court, and that the compensation amount has not been disbursed to respondent no.4 infringing any subsisting legal right of the petitioner. 4. Learned counsel appearing for respondent no.3 also submits that, as per the official records, the acquiring authority had duly deposited the entire compensation amount with the designated authority, which thereafter proceeded to disburse the same in accordance with the applicable rules and prevailing record. No material has been brought on record to indicate that the petitioner has ever succeeded before any competent forum. 5. Having considered the rival submissions and upon perusal of the record, this Court finds no legal infirmity or justification to interfere with the impugned order dated 30.09.2008 passed by the Special Land Acquisition Officer. 6. The instant petition is devoid of merit, and is accordingly dismissed. Order Date :- 10.7.2025 Anil K.
