This Criminal Miscellaneous Petition is filed by the petitioner under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 against the impugned order dated 05.06.2025 passed by the learned Sessions Judge, Raigarh, District – Raigarh (C.G.) in Criminal Revision No. 13/2025 arising out of the order dated 09.01.2025 passed in Criminal Case No. 617/2024 passed by the Judicial Magistrate First Class, Raigarh, District – Raigarh (C.G.). After arguing at length, when the counsel for the Respondent No. 1/State pointed out that after rejection of the application for discharge, charges have now been framed and the case is fixed for recording of statement of prosecution witnesses. Learned counsel for the petitioner seeks permission of this Court to withdraw this petition at this stage which is against the rejection of the discharge of application and to file approriate proceedings before appropriate forum against framing of charges. 3.
