ORDER Date : 08-01-2025 Heard Mr. U. Bori, learned counsel for the petitioner and Mr. A. Apang, learned senior counsel appearing for all the respondents.
2. This is an application under Article 226 of the Constitution of India praying for issuance of writ in the nature of mandamus and/or any other appropriate writ or direction, challenging the legality of Minutes of 110th EBI Meeting, No. Exam Cell/31/2006-2007/Vol-VI, dated 06.06.2024 whereby the FA Grade was

3. The petitioner is a 3rd year B.Tech student in North Eastern Regional Institute of Science and Technology (NERIST). The allegation against the petitioner is that during the End Semester Examination he was deemed to have engaged in unfair means during the examination and accordingly, his name was considered by the Examination Board of Institute (EBI) in its 108th Meeting for disciplinary action and thereafter, he was awarded with FA Grade vide the Revised Minutes of 110th EBI Meeting, No. Exam Cell/31/2006-2007/Vol-VI, dated 12.07.2024.
4. It is submitted by the learned counsel for the petitioner that to that effect the petitioner has filed a representation before the authority concerned on 12.08.2024 to consider his case but, till date, the representation submitted by the petitioner is not considered by the respondent authorities.
5. Learned counsel for the petitioner fairly submits that the instant writ petition may be disposed of with a direction to the respondent authorities to dispose of the representation submitted by the petitioner.
6. Mr. A. Apang, learned senior counsel appearing for the respondents submits that, though he has no instructions in the matter, however, he has no objection if direction may be given to dispose of the representation submitted by the petitioner.
7. Having heard the learned counsel appearing for the parties and considering the facts and circumstances of the case, the writ petition stands
disposed of with a direction to the respondent authorities to respond on the representation submitted by the petitioner dated 12.08.2024 and dispose of the same accordingly.
