PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/ Accused on bail in Crime No.159 of 2025 of II Town Police Station, Visakhapatnam District, was registered against the Petitioner/ Accused herein for the offences punishable under Sections 108, 318(2), 318(4) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2 2. Heard the learned counsel for the petitioner, the learned Assistant Public Prosecutor. 3. This Court dismissed the bail application of the petitioner on 09.10.2025 in Crl.P.No.9850 of 2025. At that time, the charge sheet had not been filed. Subsequently, after completion of the investigation, the charge sheet has been laid, and the present application is the second one for bail. The petitioner was arrested on 26.08.2025. He has been in judicial custody for the past 68 days. The allegation against the petitioner is that the deceased left a suicide note stating that the petitioner was responsible for her death as he betrayed her. The deceased ended her life by hanging. It is alleged that the petitioner and the deceased were in love; however, prior to that relationship, the petitioner had already married another woman. Later, he resumed his affair with the deceased and they started living together in a separate house. Thereafter, the petitioner left her company without informing her, and being unable to bear the same, the deceased took the extreme step of ending her life. 4. Considering the facts and circumstances of the case, the factum of filing of charge sheet and the nature and gravity of allegations levelled against the Petitioner/ Accused, this Court is inclined to enlarge the Petitioner/ Accused. 3 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/ Accused shall be enlarged on bail subject to he executing a bond for a sum of Rs.25,000/- (Rupees twenty five thousand only), with two sureties each for the like sum each to the satisfaction of the learned II Additional Chief Judicial Magistrate, Visakhapatnam. ii. The Petitioner/ Accused shall appear before the learned trial Court on every adjournment without fail. iii.
