02/ 29.10.2025: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Nawadih P.S. Case No. 11 of 2025, registered under sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109, 74, 324(4), 352 and 351(2) of BNS, 2023, pending in the Court of learned Additional Judicial Magistrate, Bermo at Tenughat.

Learned counsel for the petitioners submits that there is case and counter case between the parties and for the same incident both the cases have been instituted. He further submits that there is general and omnibus allegation against the petitioners and nature of injury has not been disclosed in the impugned order. He then submits that petitioners have got no criminal antecedent which is disclosed in para 17 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of assaulting upon the brother and nephew of the informant.

Considering that there is case and counter case between the

parties, even the nature of injury has not been disclosed in the impugned
order and petitioners have got no criminal antecedent which is disclosed in para 17 of the petition, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Judicial Magistrate, Bermo at Tenughat, in connection with Nawadih P.S. Case No. 11 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
