ORDER: The Criminal Petition has been filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioner/Accused No.6 on bail in Crime No.68 of 2025 of Rayavaram Police Station, Dr.B.R.Ambedkar Konaseema District, registered against the petitioner/Accused No.6 herein for the offences punishable under Sections 8(c) read with 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. As seen from the record, the allegation against the petitioner/Accused No.6 is that he, along with the other accused, was indulging in dealing with 2.00 kgs of Ganja, which is not a commercial quantity. The role of the petitioner came to light based on the confession of Accused No.1. After thorough investigation, charge sheet has been filed in this case. Although the learned Assistant Public Prosecutor submits that there are four adverse antecedents reported against the petitioner, of which one is under the provisions of ‘the NDPS Act’, it will take a
4. considerable length of time for the learned Trial Court to take up the matter and dispose of the same in accordance with law. Until such time. keeping the petitioner in judicial custody would not serve any purpose. If certain conditions are imposed, the presence of the petitioner during the trial can be secured and the interest of justice would be sub-served. 5. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the petitioner/Accused No.6 this Court is inclined to enlarge the petitioner/Accused No.6 on bail with the following stringent conditions: i. The petitioner/Accused No.6 shall be enlarged on bail subject to he executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two \ sureties for the like sum each to the satisfaction of the learned Special Sessions Judge for Trial of the Cases

The petitioner/Accused No.6 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Investigating Officer concerned, iv. The petitioner/Accused No.6 shall not commit or indulge in commission of any offence in future. V. The petitioner/Accused No.6 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. 6.
