The instant writ petition has been preferred for quashing the impugned order dated 28.08.2009 passed by respondent no.3- Addl. District Magistrate, Land Acquisition, Avas, Meerut, whereby the application of the petitioner under Section 18 of the Land Acquisition Act for reference has been rejected on the ground of limitation. 3. Learned counsel for the petitioner fairly states that relief claimed in the writ petition has become infructuous and even on merit, no case is made out at this belated stage. As such he is not inclined to press the instant writ petition. 4. In view of above, the writ petition is dismissed as not pressed.
