NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPC No. 4573 of 2025 Budhadev Anjrel Mines Shramik Vikas Samiti Registered Society Under Chhattisgarh Society Act, 1973, District Narayanpur (C.G.) Through Anil Chandel, S/o Ram Suchit Singh Aged About 50 Years, Village Antagarh, Tehsil - Antagarh, District Kanker C.G.
... Petitioner(s) versus 1 - State Of Chhattisgarh Through The Secretary, Department Of Home Affairs, Mahanadi Bhawan, Naya Raipur C.G. 2 - The Collector Dist.- North Bastar Kanker, C.G. 3 - Sub-Divisional Magistrate, Antagarh, Dist.- North Bastar Kanker, C.G. ---- Respondents For Petitioner
: Mr. Sumit Singh, Advocate For State/Respondents : Mr. Satish Gupta, GA Hon'ble Shri Justice Arvind Kumar Verma Order on Board 26/08/2025
1. By way of this petition, petitioner sought following relief(s) :
“10.1 To quash the order dated 23.07.2025 issued by the respondent No.3. 2 10.2 Any other relief deemed fit in the facts and circumstances of the case, in the interest of justice.”
2. Learned counsel for the petitioner contended that by way of this petition, petitioner is challenging the order dated 23.07.2025 passed by the Sub-Divisional Magistrate (Revenue), Antagarh, District South Bastar, Kanker, Chhattisgarh, whereby directions have been issued regulating and mandating the specific routes for the movement of iron ore transport vehicles. The impugned order suffers from multiple legal infirmities. Firstly, the Sub-Divisional Magistrate has exceeded his jurisdiction and powers under the law, as no provision of the Chhattisgarh Land Revenue Code, 1973 or any other statute authorizes him to alter or regulate transportation routes for iron ore or other heavy goods vehicles. Secondly, the order does not disclose the statutory basis or provision under which it has been issued, rendering it arbitrary and unsustainable. Thirdly, no names or specific factual basis have been disclosed in relation to the alleged events prompting such restrictions, thereby violating principles of natural justice. The petitioner further relies on the registration details recorded in the official revenue records (Case No. 122023363078, Reference No. 1776823826, registered on 03.05.2023 under Section 44 of the Chhattisgarh Land Revenue Code, 1973) to substantiate lawful rights that stand adversely affected by the impugned order. Hence, this petition. 3
3. Learned State counsel opposes the submission made by learned counsel for the petitioner and contended that the impugned order dated 23.07.2025 (Annexure P-3) passed by respondent No.3 just and proper and needs no interference. 4.
I have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. Considering the facts of the case and submission made by counsel for the respective parties. 6. Considering the impugned order passed by Respondent No.3 – Sub- Divisional Magistrate, Antagarh, District North Bastar, Kanker (C.G.) as under :
7. Taking into consideration the fact that the relief which has been sought by the petitioner cannot be granted in exercise of writ jurisdiction and
4 the order impugned passed by respondent No.3 is just and proper, in view of the considered opinion of this Court, no case is made out for any interference. 8. Accordingly, the petition being devoid of any merit is liable to be and is hereby dismissed. Sd/-
