Neutral Citation No. - 2025:AHC:84743 Court No. - 49 Case :- WRIT - B No. - 1585 of 2025 Petitioner :- Amarpal And 3 Others Respondent :- State Of Up And 4 Others Counsel for Petitioner :- Sanjai Singh Counsel for Respondent :- C.S.C.,Sunil Kumar Singh Hon'ble J.J. Munir,J. Certified copies of the order dated 10.06.2024 passed by the Board of Revenue and the Sub Divisional Officer have been brought on record through a supplementary affidavit filed today in Court. Let the affidavit accompanying the certified copies be taken on record. The petitioner's suit was decreed vide judgment and decree dated 22.12.1992 but on an application by the Gaon Sabha to set aside the decree the Sub Divisional Officer has set aside the same treating the decree to be ex parte. No doubt, the order of the Sub Divisional Officer dated 16.12.1993 appears to be utterly illegal like the judgment that was passed on 22.12.1992 but the order dated 16.12.1993 was challenged in the year 2024 after a delay of 31 years by the plaintiff/petitioner. The revision has been dismissed by the Board on the ground of inordinate and unexplained delay. The delay has been sought to be explained on ground that the petitioner did not know of the order passed by the Sub Divisional Officer earlier, which came to his knowledge upon an inspection of records. The explanation is too casual to explain this kind of a mammoth delay. There is absolutely no sufficient cause to explain the delay of 30 years in preferring the revision by the petitioner. We do not find any infirmity in the order impugned passed by the Board. This petition fails and is dismissed summarily.
