P.P. ------ 2/24.11.2025 Heard learned counsel appearing on behalf of Petitioners and learned counsel appearing on behalf of the State. 2. The petitioners are apprehending their arrest in connection with Panki P.S. Case No 13 of 2025, corresponding to N.D.P.S. Case No. 9/2025, registered under sections 8(B), 18(B), 29 of N.D.P.S. Act, pending in the Court of learned Sessions Judge cum Special Judge, NDPS, Palamau, Jharkhand. 3. Learned counsel for the petitioner submits that false allegation is made of cultivation of opium plant in the forest area. He further submits that co-accused has been granted anticipatory bail in A.B.A. No. 3450 of 2025, ABA No. 5730 of 2025, ABA No. 5911 of 2025 and ABA No.5989 of 2025 and petitioner have no criminal antecedent which is disclosed in para 10 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits 2025:JHHC:34979 2 that allegations of cultivation of opium plant are there. 5. Considering that petitioners have no criminal antecedent which is disclosed in para 10 of the petition and even land is being denied of the petitioners and allegation of cultivation of opium plant in the forest area is made and other co-accused have been granted anticipatory bail in aforesaid ABAs. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand) each with two sureties of the like amount each, to the satisfaction of learned Sessions Judge cum Special Judge, N.D.P.S. Palamau Jharkhand, in connection with Panki P.S. Case No 13 of 2025, corresponding to N.D.P.S. Case No. 9/2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023. 7.
