THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.32327 OF 2025 ORDER:
1. This writ petition is filed aggrieved by the action of the respondents for non-payment of the bills for the works undertaken by the petitioner. 2. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondent- Municipal Corporation. 3. The learned counsel for the petitioner submits that the 3rd respondent entrusted the works under the respective agreements. The details of the works are, (i) providing CC road from D.No.38/109-23 to D.No.38/109-42 at current office back side in Ward No.22 of Rayachoty Municipality, under agreement No.610/2023-24, dt.11.12.2023; (ii) providing of CC road from D.No.38/109-51 to D.No.38/109-37 at current office back side in Ward No.2 of Rayachoty Municipality, under agreement No.611/2023-24, dt.11.12.2023; (iii) Providing CC road from D.No.38/109-28 to D.No.38/109-31 in Krishnapuram area in Ward No.22 of Rayachoty Municipality, under agreement No.

612/2023-24, dt.11.12.2023; (iv) providing CC road from D.No.38/109-32 to D.No.38/109-12-4 in Krishnapuram area in Ward No.22 of Rayachoty Municipality, under agreement No. 613/2023-24, dt.11.12.2023; (v) Providing CC road from Madanapalli Road to D.No.38/113-3-41-5 in Manasa Restaurant street in Ward No.22 of Rayachoty Municipality, under agreement No. 617/2023-24, dt.11.12.2023; (vi) providing CC road from NHH-409 to D.No.38/153-A in Annamayya Family Restaurant street in Ward No.22 of Rayachoty Municipality, under agreement No.621/2023-24, dt.11.12.2023; (vii) Providing CC road from D.No.39/107-16-3 to D.No.39-107-17-1 in Annamayya Family Restaurant street in Ward No.22 of Rayachoty Municipality, under agreement No. 622/2023-24, dt.11.12.2023. 4. The learned counsel further submits that the petitioner duly executed the works to the satisfaction of the 3rd respondent.
It is further submitted that after execution of the works, the progress of the work was recorded in the M book. Later, the petitioner submitted respective final bills. The authorities of the 3rd respondent, after the quality check and after fulfilling statutory requirements, approved the respective final bills aggregating to a sum of Rs.30,18,869/- in the year 2024, but so far no payment has been made to the petitioner. -4- W.P. The learned standing counsel for the 3rd respondent, on oral instructions, submits that the works undertaken by the petitioner were completed to the satisfaction of the authorities of the 3rd respondent. However, on account of lack of funds, the payment could not be made to the petitioner till now, and that payment would be made in due course. 6. Considering the submissions that the works completed by the petitioner is not in dispute, there shall be a direction to respondents 2 and 3 to verify and release the payments due payable to the petitioner within a period of six weeks. 7. With the above direction, the writ petition is disposed of. No costs. 8. Pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N BV
