ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to enlarge the Petitioners/Accused Nos.2 & 3 on bail in Cr.No.200 of 2025 of Gopalapatnam Police Station, Visakhapatnam Commissionerate for the offences under Sections 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’).
2. Heard the
learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the allegation against Petitioner No. 1/Accused No.2, who was arrested on the spot on 27.07.2025, is that he acted as a transporter for the transportation of 22.108 kgs of ganja. The allegation against Petitioner No.2/Accused No.3 is that he sold the above-mentioned ganja to Accused No.2. Based on the confession of Accused No.2, the role of Accused No.3 has come to light. After thorough investigation, a charge sheet has been filed and the same is numbered as NSC.No.594 of 2025. 4. Considering the gravity and nature of the allegations leveled against Petitioner No. 1/Accused No.2, this Court is not inclined to allow the petition. Accordingly, the petition against Petitioner No. 1/Accused No.2 is dismissed. Except the confession of Accused No.2 against Accused No.3, there is no other incriminating material available against Accused No.3 in this case. Considering the nature of evidence available against Accused No.3, this court is inclined to enlarge Petitioner No.2/Accused No.3 on bail. Accordingly, the petition against Petitioner No.2/Accused No.3 is allowed. In the result, the Criminal Petition is partly allowed with the following
5. 6. conditions: The Petitioner No.2/Accused No.3 shall be enlarged on bail subject to him executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for the like sum each to the I. \ \ satisfaction of the learned II Additional Chief Judicial Magistrate, Visakhapatnam.
