“10.1 That, the Hon'ble High Court may kindly issue Writ of mandamus or other appropriate Writs whereby direct the Respondent Authorities to kindly consider and decide the claim of the petitioner in accordance with the Transfer Policy dated 05/06/2025 in the interest of justice. 10.2 That, the Hon'ble High Court may kindly issue Writ of mandamus or other appropriate Writs and direct the Respondents to kindly transfer the Petitioner in accordance with proposal made by the Respondent No. 02 (The Collector, Mahasamund) to the Primary Health Center, Sher, Block- Mahasamund or to Community Health Center, Tumgaon, Block- Mahasamund, in furtherance of justice. 10.3 That, the Hon'ble High Court may kindly issue Writ of mandamus or other appropriate Writs and directed the Respondents to kindly consider the representations as well as the claim of the Petitioner, in the interest of justice. 10.4 Any other relief which the Hon'ble Court deem fit may be granted.”

Learned counsel for the petitioner would submit that, the petitioner is posted as ANM at Primary Health Centre Singhoda, District Mahasamund. Considering her grievances and difficulties, she made an application for her transfer either to Primary Health Centre, Sher, Block Mahasamund, District Mahasamund or to Community Health Centre, Tumgaon, Block Mahasamund, District Mahasamund on her own expenses, which has been duly forwarded by the respondent No.2/Collector, Mahasamund to the respondent No.1 for due approval on 30.06.2025, but till date, the same has not been considered, and therefore, the respondent authorities may be directed to decide the
3 said proposal with respect to the transfer of the petitioner, in accordance with law.

On the other hand, learned counsel appearing for the State, though opposes on merits, however, he would submit that he has no objection, if such a direction is being given to the authorities to take a decision on the recommendation made by the respondent No.2 to the respondent No.1, in accordance with law.

Considering the submissions made by learned counsel for the parties, the present writ petition is disposed of directing the respondent authorities to take a decision on the recommendation dated 30.06.2025 (Annexure P/5), in accordance with law, and as per the applicable rules and circulars holding the field within 04 weeks from the date of receipt of the copy of this order.
5. The petitioner is directed to produce a copy of this order within 02 weeks from today to the respondent authorities.
