The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.727/2024, registered at Police Station City Kotwali AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN 2 Raigarh (C.G.) for alleged commission of offence punishable under Section 420/34 of Indian Penal Code (In short, IPC). 2. As per the case of the prosecution, the applicant, Satish Sahu, alongwith his accomplices, has been accused of cheating the complainant by promising to provide jobs for their children and receiving a sum of Rs. 30,61,800/- in connection with this fraudulent scheme. The allegations against Sahu suggest that he has committed a breach of trust and cheated the complainant, causing them financial harm. Thereafter, the offence has been registered against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime. He further submits that the applicant only introduced the complainant with co-accused Yashwant Patnaik, he has never cheated complainant and has not demanded any money from the complainant. He also submits that there is 8 years delay in lodging the FIR, further co- accused, namely, Nirmala Nishad has already been granted anticipatory bail by this Court vide order dated 08.01.2025 in MCRCA No.14 of 2025, a copy of which is also annexed as Annexure A/2. Hence he prays to enlarge the applicant on anticipatory bail. 4. Learned State counsel opposed the prayer for grant of anticipatory bail. 3 5. Learned counsel for the objector opposed the prayer for grant of anticipatory bail and submits that the applicant alongwith other co- accused persons have cheated the complainant by promising them providing jobs for their children and received a sum of Rs. 30,61,800/- in connection with the fraud, therefore, the anticipatory bail application of the applicant deserves to be rejected. 6. I have heard learned counsel for the parties and perused the case diary. 7. Taking into consideration the nature of allegation made against the present applicant that he alongwith other co-accused persons have cheated the complainant by promising them providing jobs for their children and received a sum of Rs. 30,61,800/- in connection with the fraud, as such, I am not inclined to grant anticipatory bail to the applicant. Accordingly, the anticipatory bail application of the applicant - Satish Sahu, involved in Crime No.727/2024, registered at Police Station City Kotwali Raigarh (C.G.) for alleged commission of offence punishable under Section 420/34 of IPC is rejected.
