Learned counsel for the petitioner submits that the W.P. (C ) No. 1588 of 2018 was dismissed for non- prosecution vide order dated 23.01.2024. Learned counsel for the petitioners submits that as the conducting lawyer was unwell, hence, he could not attend the court, when the case was called out, which resulted in dismissal of W.P. (C ) No. 1588 of 2018. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that W.P. (C) No. 1588 of 2018 be restored to its original file. Learned Addl. P.P. has no serious objection for the prayer of restoration. Considering the aforesaid submission of the learned counsel for the petitioner, W.P. (C) No. 1588 of 2018 is restored to its original file to the stage, at which, it was before its dismissal.
