1. Heard Mr. Qamrul Aziz, learned counsel for the petitioners. Also heard Ms. Soumya Sharma, learned counsel, appearing for the respondent No.1 State.
2. The present transfer petition has been filed by the petitioners with the following prayers:
“1. It is therefore most respectfully prayed that this Hon’ble Court may kindly be pleased to pass an appropriate order for transfer of Sessions Case No. 65 of 2024 “ State of Chhattisgarh Vs. Mukesh Kumar Rangari & Others” from Sessions Judge, Kondagaon, District – Kondagaon to Sessions Judge, Durg (C.G.), in the interest of Justice.
2. Any other relief as deemed fit by this Hon’ble Court.”

The prosecution story in brief is that daughter, Vani Khobragadhe (Vani Rangari), was married to respondent No. 2 on 28.11.2010 as per Hindu rites and rituals, but she was subjected to cruelty and harassment by the respondent and his family on account of dowry demands. During the marriage, she gave birth to a son, Rudraksh Rangari, on 23.11.2012 and a daughter, Aradhya Rangari, on 21.11.2020, but on account of continuous
3 cruelty, she died on 05.05.2022. Consequently, Crime No. 111/2024 was registered at Police Station Kondagaon for offences under Sections 304-B, 498-A, and 34 IPC against respondents No. 2 to 6, and the said case is pending trial as Sessions Trial No. 65/2024 before the learned Sessions Judge, Kondagaon. The petitioners, being old and infirm residents of Kharagpur (West Bengal), are required to travel over 1000 km to attend the proceedings, which is highly inconvenient and causes great hardship and expenses. Since their other daughter, Smt. Vandana Chauhan, is residing at Bhilai, District Durg, the petitioners seek transfer of the Sessions Trial No. 65/2024 from the Court of Sessions Judge, Kondagaon, to the Court of Sessions Judge, Durg, so that they may conveniently attend the proceedings while staying with their daughter.

Learned counsel for the petitioners submits that petitioner No. 1 is the complainant in the case and the mother of the deceased, while petitioner No. 2 is the father of the deceased. It is stated that the petitioners’ daughter was married to accused/respondent No. 2 at Kondagaon, and the present case pertains to a dowry death, in which respondents No. 2 to 6 are the husband and in-laws of the deceased. The petitioners belong to West Bengal, whereas the case has been registered at Kondagaon, and they are facing great difficulty in travelling from West Bengal to Kondagaon, as there is no direct train facility available. Hence, it is prayed that the present trial be transferred either to Durg or Raipur. Upon a query made by the Court,
learned counsel for the petitioners submits that the status of the trial is that ten prosecution witnesses, including the petitioners, have already been examined.
5. On the other hand, learned Panel Lawyer, appearing for the
4 respondent No.1/State opposes the prayer made by the petitioner, to transfer the case from learned Sessions Judge, Kondagaon, District – Kondagaon to Sessions Judge, Durg District - Durg (C.G.).
6. I have heard learned counsel for the parties and perused the pleadings and prayers made in the transfer petition.
7. Considering the facts and circumstances of the case, I do not find any good ground to transfer the sessions Case No. 65/2024 (State of Chhattisgarh Vs. Mukesh Kumar Rangari & Others) from Sessions Judge Kondagaon to Sessions Judge Durg (C.G.), as the ground raised by the
learned counsel for the petitioners in the present transfer application appears to be vague and ambiguous. Accordingly, the present transfer petition is dismissed.
8. However, this Court hopes and trusts that the trial Court shall make an earnest endeavor to conclude the trial as expeditiously as possible within a period of three months from the receipt of a certified copy of this order in accordance with law, if there is no legal impediment.
9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
