Present applicant ‘Sanjay Kumar Bhardwaj @ Sanjay Bhardwaj @ Gabbar, son of Sri Ramkesar’ is praying for regular bail in relation to First Information Report dated 23.01.2022 bearing FIR No. 58 of 2022, Police Station – Rishikesh, District – Dehradun which was lodged against unknown person for the offence punishable under Section 302 IPC. 4. Learned counsel for the applicant submits that present applicant is innocent and has been falsely implicated and furthermore, he is in jail since 25.01.2022 and entire prosecution case is based upon circumstantial evidence and there is no direct evidence and charge-sheet was filed on 21.04.2022, therefore, there is no need of custodial interrogation and present applicant has no previous criminal history. 5. On the other side, learned State Counsel have not disputed this fact that applicant is in jail since 25.01.2022 and charge-sheet has already been filed, therefore, there is no need of custodial interrogation and present applicant has no previous criminal history. 6. After hearing the arguments of learned counsel for the parties and further taking into consideration that applicant is in jail since 25.01.2022 and present applicant has no previous criminal history and charge-sheet has already been filed, therefore, there is no need 2025:UHC:3968 of custodial interrogation, therefore, this Court is of the view that applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant ‘‘Sanjay Kumar Bhardwaj @ Sanjay Bhardwaj @ Gabbar, son of Sri Ramkesar’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
