The issue for consideration is whether the petitioners are entitled to be granted Permanent Registration after completion of their one-year internship in the respective medical colleges/hospitals assigned by Andhra Pradesh Medical Council (APMC). 4. In the previous round of litigation, this Court observed that the APMC is under an obligation to follow the Circular dated 19.06.2024 issued by the National Medical Council (NMC). In terms of the said Circular, the petitioners were granted liberty to file an application before APMC. Upon filing of the same, the APMC was directed to pass appropriate orders in terms of the Circular dated 19.06.2024. 5. The petitioners are Foreign Medical Graduates who enrolled in a medical course for the academic periods, 2016-2022, 2017-2023 and 2018- 2023, 2019-2013 etc., respectively. The 3rd/4th year course was conducted in virtual mode due to the pandemic. It is contended that the theory classes were attended in virtual mode, whereas the practical classes were attended in physical mode, with additional classes parallel to the academic year. It is stated that between and after the regular classes, the petitioners have attended practical classes and clinical 24 training. Upon completion of the course, the petitioners obtained a Doctor of Medicine (MD) Degree. 7. After obtaining the certificate in graduation, they came down to India to practice medicine. In the said pursuit, the petitioners had appeared in the Foreign Medical Graduate Examination (FMGE), conducted by National Board of Examinations in Medical Sciences (an autonomous body under the Ministry of Health and Family Welfare, Government of India), a screening test meant to allow students who studied medicine abroad to practice in India. After qualifying in the screening test, the petitioners had underwent a 12 month Compulsory Rotating Medical Internship (CRMI) in accordance with the Compulsory Rotating Medical Internship Regulations, 2021 and the National Medical Commission (Foreign Medical Graduate Licentiate) Regulations, 2021 clinical internship as per Regulation 11 of the Screening Testing Regulations, 2002, at the respective institutions allotted APMC. 8. Thereafter, the petitioners have approached the APMC for the issuance of a Permanent Registration Certificate. However, the same has not been issued, stating that the petitioners should undergo one more year of internship. 9. Challenging the action of the respondents in not issuing Permanent Registration, and insisting that the petitioners should undergo one more year of internship, the petitioners had approached this Court earlier by way of writ petition. The said writ petitions were disposed of observing that the petitioners should approach the APMC by way of an application enclosing 25 all the relevant documents. Pursuant to the same, the petitioners approached the APMC and submitted the application. The said application was rejected by APMC, vide the impugned proceedings. While rejecting the application, the Medical Council relied on the clarification issued by the Government of India. The order of the Court was dated 29.08.2025; the said clarification appears to have been sought vide D.O. letter of the Special Chief Secretary to the Government dated 05.08.2025. Challenging the proceedings of rejection to grant Permanent Registration, the instant writ petitions are filed. 10. The primary contention of the learned counsel for the petitioners is that the FMG Regulations, 2021, particularly Regulation 5 (1) (b) of the Regulations, 2022, will not apply to any of these petitioners since they have already been pursuing their Foreign Medical Course by the date of coming into force of the regulations. The same has been clarified by the Circular of the NMC dated 04.03.2022, in its clarification in the following manner: “6. Taking into the consideration all the relevant provisions of NMC's Regulations and circumstances, the Commission decided to issue the detailed guidelines/process which is required to be followed by State Medical Councils for grant of registration of FMGs till further instructions from the Commission or implementation of NExT Exam, whichever occurs earlier. State Medical Councils should ensure the following conditions/criteria while processing, the case for grant of registration of FMGS: (i) The medical qualification/degree must be registerable to practice medicine in their respective jurisdiction of the country in which the medical degree is awarded and at par with the license to practice medicine given to citizen of that country. 26 (ii) Documentary evidence certifying successful completion of physical training or internship during the medical qualification equivalent to MBBS, if conducted in foreign institute. (iii) Copy of passport with VISA and immigration details. (iv) Foreign Medical Graduate Examination (FMGE) conducted by National Board of Examination (NBE) should be cleared by the candidates seeking registration in India. (v) If the candidate is found fulfilling, all the above mentioned criteria, provisional registration may be granted by State Medical Councils for 12 month internship or balance period, as the case may be. (vi) Internship shall be permissible in medical college hospital or hospital attached to medical colleges, permitted by the Commission. (vii) The maximum quota for allocation of internship to FMGs must be restricted to additional 7.5% of total permitted seats in a medical college. (vii) State Medical Councils should obtain an undertaking from the medical college that no amount/fee is charged by the medical college from the FMGs for permitting them to do their internship. The stipend & other facilities to FMGs should be extended equivalent to Indian Medical Graduates being trained at Government Medical Colleges as fixed by the appropriate authority applicable to the institution/University or State.” 11. It is further contended that the case of the petitioners would squarely fall within the clarification Circular dated 19.06.20204, which clarifies that students who have adequately compensated for their online classes with physical, offline classes and subsequently passed an examination equivalent to MBBS in India shall be eligible for a year of mandatory internship. It is contended that the petitioners have sufficiently compensated for their online classes with offline classes during the 4th and 5th year of the course, and 27 during their respective completion of the academic course in the Foreign Medical Institution. 12. The further argument of the learned counsel for the petitioners is that the respondents have placed reliance on the Government of India clarification dated 07.08.2025, despite the directions of this Court in the previous round of litigation to issue Permanent Registration Certificate in terms of the public notice dated 19.06.2024 of the NMC of India. 13. It is contended that, having passed the other tests, such as the screening test and the one-year internship, and having compensated for the online classes with offline classes, the APMC's finding that the petitioners have not sufficiently compensated for the online classes is unsustainable. 14. It is argued that all Indian Citizens and Overseas Citizens of India who enrolled in a Foreign Medical Institution before 18.11.2021 are subject to the MCI Screening Test Regulations, 2002. The NMC, FMGL Regulations, 2021, including requirements for minimum course duration, internships abroad, and internships in India, do not apply to these students. They must qualify the Screening Test (FMGE) under the 2002 Regulations to obtain Provisional or Permanent Registration in India. Eligibility is determined by the 2002 Regulations, which require a recognized primary medical qualification and compliance with the requirements in effect at the time, such as obtaining an Eligibility Certificate from the Medical Council of India (for admissions from 15.03.2002 to before May, 2018). The NMC FMGL Regulations, 2021, apply 28 only to candidates who enrolled in a Foreign Medical Institution on or after 18.11.2021. 15. On the other hand, the APMC in the impugned orders specific reference has been made to clarification of the NMC, dated 19.06.2024, interprets the said Circular as if the entire portion of online course should be repeated again while attending physical classes/internship. The contention of the petitioners is that the Foreign Medical Graduation Regulations FMGL, 2021 would not apply to their case. It is contended that the NMC also vide Circular dated 04.03.2022 had clarified that FMGL Regulations, 2021 would not apply to the candidates who have joined their undergraduate medical education in foreign institutions prior to 18.11.2021 and shall be governed by provisions previously applicable regulations namely (“the Screening Regulations 2002” and “the eligibility requirement for taking admission in an undergraduate medical course in a Foreign Medical Institution Regulations, 2002”). 16. To have a bird’s eye view of the case, it is relevant to discuss each of the Notifications/Circulars issued from time to time on the subject issue, after 2021. (A) The National Medical Commission(Compulsory Rotating Medical Internship) Regulations, 2021. (B) National Medical Commission (Foreign Medical Graduate Licentiate) Regulations, 2021. (C) Circular Dated 04.03.2022. 29 (D) National Medical Commission’s Notification dated 09.05.2023. (E) Public Notice dated 07.12.2023. (F) Circular Dated 09.05.2023. (G) Public notice dated 07.06.2024. It has to be examined if the above regulations/circulars/notices would apply to the case of the petitioners in the subject writ petitions. (A)The National Medical Commission (Compulsory Rotating Medical Internship) Regulations, 2021, would not apply to the case of the petitioners, as provided under Clause 2 (b) of Schedule II of the said CRMI Regulations, 2021. (B)National Medical Commission (Foreign Medical Graduate Licentiate) Regulations, 2021, would not apply to the case of the petitioners in the light of Regulation No.5 of the said Regulations and the Clause (b) of the Circular of NMC dated 04.03.2022. (C)Circular Dated 04.03.2022, provides that “The Commission hereby reiterates that the provisions contained in FMGL Regulations, 2021 are not applicable in the following cases: a. Foreign medical graduates who have acquired a foreign medical degree or primary qualification, as the case may be, prior to 18th November, 2021; b. Candidates who have joined their undergraduate medical education in foreign institutions prior to 18th November, 2021; and c. Such foreign medical graduates who are specifically exempted by the Central Government, by notification.” (D)National Medical Commission’s Notification dated 09.05.2023, Whether the notification dated 09.05.2023 would apply to the fact situation? Particularly, Clause X of the notification. 30 If it is determined that this clause would not apply to the case of the petitioners, inasmuch as, as observed above, Compulsory Rotating Medical Internship (CRMI), 2021, would not apply to the case of the petitioners, the rest of the circulars, which are in continuation of this notification, also would not apply. However, I’m of the view that having regard to the Covid situation, the case of the petitioners would at best would fall under Clause (X) of the notification dated 09.05.2023, which provides for completion in offline mode or to supplement the online theory subjects/classes by offline practical and clinical training, and after obtaining a medical qualification registerable in that country where it is being acquired. After qualifying in the FMG Examination, the FMGs shall undergo a one-year internship. (E) Public notice dated 07.12.2023, deals with (a) Internship of FMGs who had returned to India in their final year owing to pandemic and war and completed the course through online, including the examination, have to undergo two year internship {1 year Clinical internship in lieu of their deficiency in training in the foreign country from the parent college + 1 year CRMI}, (b) FMGs who had break in the penultimate year of study and completed course through online mode including the examination {2 years Clinical internship in lieu of their deficiency in training in the foreign country from the parent college + 1 year CRMI}. This circular has no application to the facts of the present case, since all the petitioners had online classes in their third year of the course (except W.P.No.32012 of 2025 and W.P.No.31228 of 2025) 31 (F) Public notice dated 07.06.2024, This Public notice, has been issued in continuation of the circular 09.05.2023 to prevent false and malicious compensatory certificates being submitted by FMGs falling under Clause (X) of the Circular dated 09.05.2023, from their parent universities to comply with the conditions stipulated therein, thus the NMC has taken a decision that all FMGs who have attended online classes for any duration during their course completion were required to qualify the FMG examination and undergo two years of CRMI as mentioned under circular dated 09.05.2023. (G)Public Notice dated 19.06.2024, The stipulation of 2 years of CRMI as provided under public notice dated 07.06.2024 has been dispensed with and it has been clarified that all the FMGS who have sufficiently compensated classes in physical onsite in lieu of the online classes and subsequently passed examination equivalent to MBBS in India shall be eligible for one year mandatory internship as specified under CRMI Regulations, 2021. The Circular that would be applicable to the case of the petitioners is 19.06.2024. The respondents have allowed the petitioners to sit for the Screening test conducted by National Board of Examinations in Medical Sciences after being satisfied regarding the academic curriculum of the petitioners and allowed them to attend for one year internship, having done so refusing to issue Permanent Registration on the basis of some clarification that they have got from the NMC is unsustainable. 17. The petitioners, in support of their claim, are relying on the compensatory certificates issued by the respective Universities. However, the APMC considers the said certificates as not sufficiently being compensated in 32 equivalence to the online classes. In my considered view, the observation of the APMC is misconceived. 18. The APMC should have borne in mind that it is not necessary that the equivalent portion of the course attended online should be extended. In other words, to be more precise, the words used in the Circular are to the effect that students who have “sufficiently compensated the classes in physical on-site in lieu of online classes”. The same would not amount to mean that the period of academic curriculum or academic year should be proportionally stretched or extended. The purport of the stand taken by the APMC is that the equivalent number of classes which have been attended in online mode should be attended separately by extending the equivalent period of academic period by extending their period of stay in foreign country, such an interpretation is an absurd interpretation and the said contention of the APMC is not sustainable. 19. In any event, having regard to the fact that, after being satisfied with the offline classes vs. online classes, the petitioner was allowed to write the FMG screening test, the Provisional Registration was issued, and the petitioner was asked to attend a one-year CRMI. In light of the tests having been passed and passing through the different stages, in light of the Circular dated 19.06.2024, they are entitled to be granted Permanent Registration. Vide the Circular dated 19.06.2024, it has been clarified that those students who have compensated for the online classes and offline classes are eligible to be considered for only a one-year internship. In the facts of the present 33 case, all the petitioners have been granted a Provisional Registration Certificate and have completed their one-year internship, which is not specified under FMGL, 2002, the applicable regulations in the facts of the case, and although the petitioners are governed by the provisions of Section 13 of the National Medical Council Act, 1959. The NMC has clarified that the FMGL, 2021 would not apply to students who have already been in foreign countries for pursuing the medical course by the date of coming into force of the regulations of 2021. The subsequent Circulars which have emanated from the same in the form of clarifications, the petitioners herein who have all entered the medical course before coming into force of FMGL, 2021 were governed by NMC Act,1959 particularly Section 13 of the NMC Act, 1959. However, having regard to the COVID-19 situation during the relevant period of time, in lieu of the missing classes and practical classes in their institute in the foreign country, applying and assuming that the stipulations mentioned under Clause (X) of the notification dated 09.05.2023 should be met with, the petitioners were required to undergo a mandatory screening test, and 12-month CRMI. Having the said requirements been met by the petitioners, the APMC is not obligated under law to scrutinize the nature, structure, and schedule of the curriculum of the foreign university under the pretext of verifying the compensatory certificates submitted by the petitioner. The same was tested in the screening test and the internship and at the time of granting provisional registration. Further, the impugned order of the APMC is based on clarification issued by NMC pursuant to the clarification sought by APMC 34 itself. The said clarification has no enforceability, having regard to the fact that the same was never published nor was made public, probably an opinion of author of the said document. It is pertinent to observe that the efforts and attempts of the NMC would have been well appreciated if it had come forward with relevant, comprehensive circulars or clarifications during the relevant period and at the threshold of the exigencies, namely the Covid-19 pandemic and the Ukraine War. The series of public notices, circulars, and clarifications on the subject, which have been issued after the students have exited from the Foreign Universities and after the screening test, would only cause confusion and mental agony for students who have come back to India to pursue their further career. They should not be left uncertain. 20. The impugned proceedings of the APMC rejecting the case of the petitioners for grant of Permanent Registration on the ground of its interpretation that the sufficiently compensated would imply the equal number of days or months of academic period should be extended, placing reliance on the clarifications said to be have been obtained by it from NMC, which has no legal enforceability is liable to be set aside. At this juncture, the petitioners are therefore entitled to be granted Permanent Registration subject to condition that they have produced the Compensatory Certificate before the APMC, having regard to the fact that the petitioners have already passed through the prescribed screening tests and internship of one year. 21. In view of the above, the order impugned is set aside. The respondents shall issue proceedings for the grant of Permanent Registration 35 to the petitioners herein, without insisting that the petitioners should undergo internship for one more year after verifying, ensuring that an apostilled compensatory certificate has been filed by the respective students and after ensuring that the petitioners have completed the one-year internship at the institutions allotted by the APMC, within two (2) weeks from the date of receipt of the order. Those petitioners who have not yet filed such compensatory letters are at liberty to file a set of duly apostilled compensatory letters before the APMC. Upon filing such letters, the respondents are directed to pass appropriate orders as directed above. 22. With the above directions, the writ petitions are disposed of. There shall be no order as to costs.
