The Court made the following ORDER:
Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 4 and the learned counsel appearing for the respondent No.5. 2.
This writ petition was filed questioning the action of the 4th respondent/ Tahsildar in trying to disposses the petitioner from the subject land in Sy.No.72/1 an extent of Ac.2.93 cents, Bondalagunta Village, Ramakuppam Mandal, Chittoor District and the deletion of name of the petitioner in revenue records, and mutation of revenue records in favour of the 5th respondent, without following the due process of law. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that the then Tahsildar, Kuppam taluk granted DKT patta to the petitioner vide 240/1385, dated 18.11.1975, but he is not residing in Bondalagunta Village and now he is residing at Bangalore as per the revenue enquiry. As per the revenue enquiry, the then Tahsildar, Ramakuppam Mandal has cancelled the petitioenr’s DKT patta due to the violation of DKT Rules in the year 2009, but the connected file is not available in the office of the 4th respondent. Hence, the subject land was assigned DKT to the 5th respondent vide 36/04/1419, dated 29.03.2010 and E-pattadar passbook was issued vide Khatha No.374 in Sy.No.72/1, to an extent of Ac.2.93 cents of Bondalagunta revenue village, Ramakuppam Mandal, in the year 2016 and since then, the 5th respondent is in possession of the subject land. 4
4. In reply, the learned counsel for the petitioner submits that the petitioner is not aware of the cancellation of his DKT patta bearing No. 240/1385, dated 18.11.1975. 5. In view of the above said facts and circumstances and upon consideration of the rival submissions made, liberty is given to the petitioner to work out his remedies as per law, if so aggrieved against the cancellation of his DKT patta and the petitioner is permitted to approach the authorities concerned for the redressal of his grievance. 6. Accordingly, the writ petition is disposed of. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed.
