THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO.466 OF 2024 ORDER: 1. This Contempt Case is filed complaining willful disobedience in implementing the Order dated 10.02.2023 passed by this Court in I.A.No.1 of 2023 in W.P.No.30516 of 2023. 2. Heard Sri K. Muralidhar Reddy, learned counsel for the petitioner, learned counsel for the respondents and perused the material available on record. 3. During pendency of the writ petition, on 04.11.2023, this Court passed the following order in I.A.No.1 of 2023 in W.P.No.30516 of 2023. “Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents. Considering the submissions made by the learned counsel for the petitioner and the learned Government Pleader for the respondents and on perusal of the material placed on record, there shall be an interim direction directing respondent Nos.4 to 11 not to interfere with the peaceful possession of the petitioner in respect of the subject property.” 2 4. Learned counsel for the petitioner submits that, without implementing the orders of this Hon’ble Court in I.A.No.1 of 2023 in W.P.No.30516 of 2023 dated 04.11.2023 in true spirit, the respondents deliberately flouted the orders of this Court. This inaction itself on the part of the respondents amounts to violation of the orders passed by this Court in I.A.No.1 of 2023 in W.P.No.30516 of 2023 dated 04.11.2023. He further contends that, failure on the part of the respondents in implementing the orders of this Court would amount to disobedience of the orders of this Hon’ble Court, and, therefore, they are liable for punishment under Sections 10 to 12 of the Contempt of Courts Act. Complaining the same, the petitioner filed the present Contempt Case. 5. Respondent No.4 filed counter affidavit. Basing upon the counter affidavit, learned counsel submits that, the 4th respondent never interefered with the possession of the property of the petitioner, therefore, the 4th respondent never violated the orders of this Court and requested to close the contempt case against the respondents. 6. Having heard the submissions of the respective counsel and upon perusal of the material available on record, it appears that, in 3 compliance of the order of this Court in .A.No.1 of 2023 in W.P.No.30516 of 2023 dated 04.11.2023, the respondents never interefed with the peaceful possession and enjoyment of the property of the petitioner, as such, the contempt case is liable to be closed. 7. In the result, contempt case is closed. No order as to costs. 8.
