Neutral Citation No. - 2025:AHC:142763-DB Court No. - 21 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 837 of 2025 Petitioner :- Pramod Kumar Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Vinod Kumar Counsel for Respondent :- Dinesh Kumar Singh,A.S.G.I.,C.S.C.,Mahendra Pratap,Paras Nath Rai Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J. 1. Heard learned counsel for the petitioner, Sri Paras Nath Rai, leaned counsel appearing on behalf of respondent No.1, Sri Dinesh Kumar Singh, learned counsel for respondent No.2 and learned Standing Counsel for the State-respondents. 2. The instant petition filed ostensibly in public interest, is for issuing a writ of mandamus commanding the respondent/authorities to remove the difficulties in the way of the petitioner and other residents by changing the T-shape of turning point of link road to V-shape. 3. The respondents have submitted written instructions, and the stand taken is that at the junction of link road and NH 24(29E) there is no over bridge, and on the said road there is also no dense abadi. In other words, they have expressed their inability to construct any road as suggested by the petitioner. 4. In our considered opinion, the decision as to whether any change has to be made in the existing road is the domain of the experts, and this court under Article 226 does not find it proper to issue any direction in that behalf. We leave it open to the petitioner to represent before the Project Director NHAI, so that the suggestion made by the petitioner is also duly taken into consideration while making the planning. 5. The writ petition stands disposed of. Order Date :- 20.8.2025 Ashish/- (R.M.N.Mishra, J.) (Manoj Kumar Gupta, J.)
