JUSTICE S SUNIL DUTT YADAV ORAL ORDER The petitioner has sought for issuance of writ of mandamus to respondent No.2 to consider representation dated 28.11.2024 and to grant saguvali chit with respect to land measuring 32 guntas in Survey No. 58 of Baktharahalli Village, Kasaba Hobali, Hosakote Taluk, Bangalore Rural District. 2. Petitioner submits that he has made an application for regularization of unauthorised cultivation and copy of the application in Form 50 was made. It is further submitted that though mutation has been entered, however when he sought for transfer of khata upon the - 3 - HC-KAR NC: 2025:KHC:48724 WP No. 29923 of 2025 death of their father, the authorities have taken a stand which is now placed before the Court by the Government advocate that the application for regularization has been pending before the Committee for regularization of unauthorised cultivation. 3. Learned AGA submits that in terms of the proceedings produced by the petitioner at Annexure- C itself would indicate that no decision was taken as regards the application in light of case that is pending. It is further submitted that if this aspect of pending case is clarified by the petitioner, the Committee would be in a position to take an appropriate decision and subsequently other requests of the petitioner would then be considered. 4. In light of such stand by learned AGA, the petition itself could be disposed of in terms of the following; - 4 - HC-KAR NC: 2025:KHC:48724 WP No. 29923 of 2025 ORDER i. The petitioner to appear before the third respondent on 10.12.2025. ii. The petitioner to clarify in writing as to the observation made in the Committee regarding pendency of case. Upon such clarification being made, the Committee to take an appropriate decision within 3 months thereafter. iii. In the event the Committee passes an order in the affirmative as regard to application of the petitioner, the other requests of the petitioner may be considered appropriately as made in the present petition.
