JUSTICE G BASAVARAJA ORAL ORDER The petitioners have filed this petition under Section 482 of the Bharatiya Nyaya Sanhita, 2023 ('the BNS 2023' for short) for grant of anticipatory bail in the event of their arrest in crime No.552/2025 for the offence punishable under Sections 318(4) and 319(2) of the BNS 2023 and Section 66D of the Information Technology Act, 2000 ('the IT Act' for short). 2. The brief facts leading to this petition are that on the basis of the complaint filed by one Shrishail Ningappa Patil, Whitefield CEN Police have registered the case in Crime No.552/2025 against accused Chaitali Shah and others for the commission of offence under Sections 318(4) and 319(2) of the BNS 2023 and Section 66D of the IT Act. The petitioners filed an application under Section 582 of the BNS 2023, which was registered in Crl.Misc.No.9245/2025. The same came to be rejected by the Trial Court. Considering the facts and circumstances of the case, nature and gravity of the offence, I am of the considered opinion that it is just and proper to allow this application. Accordingly, I proceed to pass the following: ORDER (i) The petition filed under Section 482 of BNS, 2023 is allowed; (ii) Petitioners No.1 and 2 shall be released on bail on executing the self bond for a sum of Rs.1,00,000/- each with one surety for like sum to the satisfaction of the Investigating Officer in the event of their arrest in crime No.552/2025 of Whitefield CEN Police; (iii) The petitioners shall assist the Investigating Officer for investigation; - 6 - HC-KAR NC: 2025:KHC:54766 CRL.P No. 17437 of 2025 (iv) The petitioners shall not tamper/threaten the prosecution witnesses; (v) The petitioners shall deposit Rs.5,00,000/- within one week before the Trial Court; (vi) After depositing the amount, Trial Court is directed to deposit the same in fixed deposit in the name of Court in any nationalised bank for a period of one year under auto renewal scheme.
