PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.4 on bail in Crime No.298 of 2025 of Kancherapalem Police Station, Visakhapatnam District, registered against the Petitioner/Accused No.4 herein for the offences punishable under Section 20(b)(ii)(C), 25 read with Section 8(c) of the Narcotic Drugs and Psychotropic , 2 Substances Act, 1985 (for brevity ‘the NDPS Act’) and under Sections 106(1), 125(a) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2. Heard the learned counsel for th^ petitioner and the learned Assistant I ' Public Prosecutor. Perused the record. 3. The petitioner is aged about 20 years and she is a female. She was arrayed as accused No.4 in this crime. The allegation against the petitioner is that she was indulged in dealing with 21.3 kgs of ganja along with other accused. The seized contraband is a commercial quantity. The petitioner arrested on 21.08.2025. She has been in judicial custody for the past 69 days. The petitioner is permanent residents of Pedakakani, Guntur District. She has got fixed abode. If conditions are imposed, there is no likelihood of her absconding or evading the process of law. So far, five witnesses have been examined, all of whom are material and official witnesses. Therefore, the possibility of the petitioner threatening the official witnesses, tampering with evidence, or hampering the investigation does not arise. The period of custodial interrogation against the petitioner is completed. was The learned counsel for the petitioner submits that the petitioner is a pregnant and her expected date of delivery is on 27.12.2025. To that effect, the Deputy Civil Surgeon, Central Prison, Visakhapatnam has issued medical certificate on 06.10.2025. 4. 3 Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.4, this Court is inclined to enlarge the Petitioner/Accus^ed No.4 on bail. 5. 6. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The petitioner/Accused No.4 shall be enlarged on bail subject to she executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only), with two sureties each for the like sum each to the satisfaction of the learned VII Additional Judicial Magistrate of First Class, Visakhapatnam. ii. The petitioner/Accused No.2 shall cooperate with the investigation. The petitioner shall appear before the learned trial Court after cognizance is taken on each and every adjournment without fail.
