Heard Mr. Sanjay Pathak, learned counsel for the petitioner as well as Mr. Swajeet Ubeja, learned Panel Lawyer, appearing for the State/respondent. 2. The present petition has been filed by the petitioner under Section 528 of the Bhartiya Nagrik Suraksha Sanhita with the following prayers :- “I. That, the Hon’ble Court may kindly be pleased to allow the instant petition under section 528 of BNSS 2023 filed by the petitioners. ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA 2 II. That, the Hon’ble Court may kindly be pleased to quash the FIR bearing Crime No. 320/2025 registered on 03.06.2025 at Police Station Ambikapur Dehat Gandhinagar, Ambikapur, Distt. Surguna (C.G.) for the offence under section 420 of IPC.” 3. From perusal of petition, it transpires that instant petition has been filed for quashment of the FIR registered by the complainant, but the complainant has not been made as party respondent in the instant petitioner, which goes to show that he has drafted the prayer in a very casual manner. 4. Accordingly, the instant petition is dismissed on this ground alone with liberty to file afresh petition by making the complainant as one of the party respondent, subject to depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court for wasting the precious time of the Court and the same shall be transmitted to Government Special School for Intellectually Retarded Girls, Gaganpur, Ambikapur District – Sarguja, Chhattisgarh. 5. Certified copy of the documents annexed with this petition shall be returned to the counsel for the petitioner after retaining photocopies of the same.
