Learned counsel for the applicant submits that the applicant is absolutely innocent and has been falsely implicated in the present case. False allegation has been made that with the aid of two other accused named in the F.I.R. the applicant got executed a sale deed in favour of informant while submitting forged documents of owner in which his heirs were shown wrongly. Learned counsel further submits that the alleged sale deed was not executed by the applicant, rather it was executed by another co- accused, Pankaj in favour of informant in which the applicant was the only a witness, thus, applicant has no role to play in commission of offence and he has been made accused with false and frivolous allegations due to ulterior motive. 4. Per contra, learned A.G.A. as well as learned counsel for the informant have opposed the prayer for bail of the applicant by contending that the applicant is the main accused. The said land was of different person in which by showing one co-accused Sushil Kumar alias Toma, as owner of the said land he got prepared forged papers and got executed the alleged sale deed, therefore, innocence of the applicant cannot be adjudged at pre trial stage and he does not deserve any indulgence. 5.
Keeping in view submissions of learned counsel for the parties, gravity of offence, nature of allegations and all the attending facts and circumstances of the case, without expressing any opinion on the merits of the case, no case for bail is made out. 6.
